1.2.1 When do we process information about you?

We collect and process personal data about you when you

The information we collect about you is processed exclusively for the following purposes:

  • to provide information that you have requested or to otherwise respond to your request;
  • to fulfill Eisai’s obligations under the Pharma Code and Pharma Cooperation Code, such as disclosing any payments or transfers of value made to you;
  • to fulfill Eisai’s legal obligations, e.g. in connection with the reporting of side effects and/or quality problems with Eisai products, or in the context of official requests for information;
  • for advice on the use of Eisai products;

Withdrawing or changing your consent
If you consent to being contacted for marketing purposes by means of electronic data communication (e.g. email), you have the right to withdraw your consent.   • Details of any potential safety or quality issues with an Eisai drug you are reporting,
  • Information about you or a third party who has taken the medicine (if reporting a potential safety issue), including age, gender, health status and the contact details of the doctor who prescribed the medicine,
  • Details of your social media activity, such as likes, click-through rates, re-shares, impressions, etc., relating to Eisai social media posts, Eisai products or a therapeutic area in which Eisai has an interest,
  • minimal information about comments made when you comment in a public forum about an Eisai product or therapeutic area in which Eisai is interested.

1.7.3 How do we use your personal data?

The information we collect from you will only be used to

  • Managed Access programs;
  • respond to your request for medical advice and refer you to your doctor;
  • Respond to your request for medical information by providing information available in the patient information leaflet where relevant to your query;
  • fulfill Eisai’s legal obligations with respect to the reporting of safety or quality issues related to Eisai pharmaceuticals;
  • for the assertion, exercise or defense of legal claims.

1.7.4 How long do we store your data?

If you participate in a managed access program, your data will be retained for up to 25 years after the program ends. If you contact us to request medical information, a copy of your request and Eisai’s response will be retained for 5 years from the date of your request. If you contact us about a medical or safety issue relating to an Eisai medicine, or your request for medical information includes a safety issue, we will retain your data for 10 years after the marketing authorization for the medicine has expired in accordance with applicable laws.

1.8 I am a patient spokesperson or speak at an Eisai event or participate in an Eisai video

If you are a patient advocate or have been invited to speak at an Eisai event or participate in an Eisai video, the information in this section is relevant to you.

1.8.1 When do we process information about you?

We collect and process personal data about you when you

  • interact with Eisai employees or our representatives;
  • interact with our posts on social media;
  • are interested in and/or participate in events organized or sponsored by Eisai;
  • are a patient spokesperson and talk about your experiences and your disease at an event organized by Eisai, such as an hhc event;
  • you agree to speak at an event organized by Eisai;
  • appear in an Eisai video or other material.

1.8.2 What information do we collect about you?

We only collect personal data that is relevant in connection with the purposes stated in this section, such as possibly:

  • Your name;
  • Your contact information such as address, telephone number(s) and e-mail address;
  • Information about your health, your family members or other information that you voluntarily provide or make available to Eisai.

1.8.3 How do we use your personal data?

The information we collect from you will only be used to

  • to facilitate your visit and/or access to the Eisai event and to support your presentation;
  • to enable the recording of a video in which you are involved;
  • to enable the creation of materials in connection with the event you are attending (e.g. by taking photos).

1.8.4 How long do we store your data?

We will keep your data for 10 years from the date of your presentation. If you participate in an Eisai video or your data is used in Eisai materials, we will retain this information for 10 years from the date of publication, unless a different period is individually agreed with you.

2 Information about your rights, the disclosure of your data, changes to this privacy policy and how to contact us

2.1 What rights do you have?

With regard to the personal data we have collected about you, you have the following rights under certain circumstances. You can

  • receive information about your personal data that we process,
  • request the correction of your personal data,
  • request the deletion/blocking of your personal data,
  • ask us to restrict the processing of your personal data,
  • object to our use of your personal data,
  • request an electronic copy of the personal data you have provided to Eisai,
  • revoke your consent to the processing of your data for the future and
  • complain to the competent supervisory authority about unauthorized data processing.

We will consider your requests in accordance with applicable data protection laws. Please note that Eisai may not be able to comply with your request in full or in part for legal or other important reasons.

If you have requested erasure, we will either erase or anonymize your personal data depending on the legal possibility. In cases where it is not legally possible for us to erase or anonymize your data at this time, we will continue to store your data securely after the purpose has expired until the time at which erasure or anonymization is possible.

If you withdraw your consent to the processing of your personal data, we would like to point out that this has no influence on the lawfulness of the processing before the time of withdrawal.

2.2 Requirement or obligation to provide data

Unless expressly stated at the time of collection, the provision of data is not required or mandatory. However, such an obligation may arise from legal requirements or contractual regulations.

2.3 To whom do we disclose your personal data?

When processing your data, we work together with the following service providers who may have access to your data:

  • other companies in the Eisai Group (see also below);
  • External suppliers or potential suppliers who provide services or systems that Eisai uses to securely process your data; when conducting video conferences, data is processed via third-party servers, among other things.   • External service providers that process data on behalf of Eisai, including providers of web analytics tools and web hosting providers;
  • Authorities that are legally authorized to request disclosure of the personal information we hold;
  • Industry associations scienceindustries, vips and Interpharma for publications within the framework of the Pharma Cooperation Code (PCC) or in connection with compliance with the provisions of the Pharma Code;
  • Consulting company;
  • Pharmaceutical companies with which Eisai has a co-promotion / co-marketing relationship;
  • purchasers or potential purchasers of parts of the business or shares that we are selling (or intend to sell); and/or
  • Third parties, if required by law (e.g. tax and customs authorities).

2.4 Disclosure of your data to recipients outside Switzerland

As part of a global group of companies, we involve other Eisai companies that support us in data processing. These group companies may also process data outside Switzerland, e.g. in the EU, UK, Japan or the USA. These group companies process the personal data only for the stated purposes.

We also use external suppliers to provide various business tools, including the tools we use for recruitment, human resources, procurement, finance and clinical trial organization; we share your personal data with such external suppliers as data processors. Some of these suppliers may be based outside the EEA.

Some of these countries may not have a data protection authority and/or data protection laws and/or do not grant data subject rights, so you may not be able to enforce your rights in the same way as within Switzerland or the EU and the recipients may not be legally obliged to protect your data in the same way as Swiss or EU standards. Eisai will take all necessary steps to ensure that your personal data is protected in this case.

We have put in place procedures to ensure that all third parties with whom we work in connection with the processing of your personal data, including other Eisai companies or subsidiaries, apply the same data protection standards as those applicable in the EU. This includes exercising due diligence when working with such external companies (e.g. checking the security measures they apply to protect the data) and entering into contracts that contain appropriate data protection provisions, such as those contained in the EU standard contractual clauses recommended by the European Commission as providing adequate protection for the personal data of EU citizens, which also apply to Switzerland.

Eisai may transfer personal data to competent authorities in third countries if necessary to obtain product approvals and for the purpose of safety reporting, provided that the transfer is necessary for important reasons of public interest, as these interests are recognized by law.
